These terms govern your purchase and use of BenchRecon research reports.
Service Description
BenchRecon provides per-case research exhibits compiled from public records. Officer Lookup reports compile officer complaint and certification-discipline records, each row cited to the underlying public source. The Jury Instruction Brief reproduces court-published standard jury-instruction text with its amendment history. Federal sentencing exhibits present comparable case distributions from United States Sentencing Commission public datafiles for a specific offense level, criminal history category, and district cell.
Reports are delivered as PDF (and, where applicable, DOCX) attachments via email following payment confirmation. Delivery typically occurs within 24 hours of a completed purchase; several products deliver within minutes.
Eligibility
BenchRecon is intended for use by licensed attorneys and their authorized staff. By purchasing a report you represent that you are a licensed attorney or are acting under the supervision of one.
Warranty Disclaimer
BenchRecon reports are public-records data exhibits provided AS-IS without warranty of merchantability or fitness for a particular purpose. Counsel is responsible for verifying every source citation and for the legal judgment of how the record applies to a specific case. BenchRecon's liability is limited to the purchase price.
The data in each report is drawn directly from the public record it cites — officer-conduct datasets, court-published instruction text, or USSC public datafiles — and reflects those published records. BenchRecon makes no representation that any particular record will support any particular argument. The report shows what the public record holds — the legal judgment is counsel's alone.
Not Legal Advice
BenchRecon reports are research assistance tools. They are not legal advice and do not establish an attorney-client relationship of any kind between the purchaser and BenchRecon.
Limitation of Liability
To the maximum extent permitted by applicable law, BenchRecon's aggregate liability for any claim arising out of or related to a report is limited to the amount paid for that report. BenchRecon is not liable for indirect, incidental, consequential, or punitive damages of any kind.
Refunds and Corrections
Refund and correction terms are set out in the Refund Policy, which is incorporated by reference into these terms.
Intellectual Property
The report format, composition methodology, and delivery infrastructure are proprietary to BenchRecon. The underlying public records — officer-conduct data, court-published instruction text, and USSC sentencing data — are public government records. Purchasers may use their delivered report for the case matter for which it was purchased. Resale or redistribution of report files is prohibited.
Governing Law
These terms are governed by the laws of the State of California without regard to conflict of law principles.
